i want to know if the nj soil erosion and sediment act applies to homeowners if they are just clearing out a?
hillside of weeds and brush, and are planning on putting grass and shrubs our town put a stop work order on us and wants us to hire an engineer to put a control plan in place wich is going to cost us alot of money.
ok i am also questioning how they measured because under the act it says that if it is less then 5,000sqft we don’t have to submit a plan i had 2 other people measure and it is under that.
also i just looked up the act and i am a little confused because how i understand this it is only for new developement and subdivisions. under “project” i think what it is saying that this does not apply to homeowners maybe i am reading it wrong i just want this clarified before i hire someone when i don’t need to.
You already have your answer. The city has issued you a stop work order till you submit a plan. This is common in many areas and is a way of protecting streets, other property, sewer systems and the like. Either you get the plan, then do the work, or do the work without a permit and face a fine, or face having to redo it as it was before you did any work.
